A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR TERRA FIRMA DEVELOPMENT COMPANY,LTO. FOR
PROPERTY LOCATED AT 156TH STREET N.E. AND TWIN LAKES AVENUE,
ARLINGTON,WASHINGTON.
WHEREAS,on October 12,1995 TERRA FIRMA DEVELOPMENT
COMPANY,LTD.applied for a utility variance for twenty-seven
(27)water connections without sewer for property located at
156th Street N.E.and Twin Lakes Avenue,Arlington,Washington;
and
WHEREAS,on October 23,1995 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant's property is within the CWSP and Urban
Growth Boundary but outside the City limits and RUSA boundary.
2.There is a 12-inch water main and 12-inch gravity sewer
main in 169th Street N.E.The existing sanitary main in 169th
Street N.E.is approximately 3,000 feet from the proposed site.
Trunk line "F"located in Smokey Point Blvd.is approximately
1,200 feet to the east of the site.
3.By letter dated October 11,1995,Snohomish County PUD
No.1 declined involvement with the applicant's proposed
subdivision.
4.The applicant's request for twenty-seven (27)water
connections without sewer is justified based upon the distance
from the nearest sewer sanitary main that can serve the property.
5.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
6.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
8.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system

or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is single-family residential.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to twenty-
seven (27)water connections without sewer is hereby granted
subject to the following conditions:
a.Applicant shall be required prior to connection to
the City's water utility to execute covenants agreeing to
annex to the City.
b.This utility variance is granted subject to the
condition that the service shall be extended to the
applicant's proposed subdivision only.
2.Any party aggrieved by this resolution shall have the
right to file an application for a writ of certiorari in
Snohomish County Superior Court;PROVIDED,that the application
must be filed and served within 20 days of the date of this
resolution.
