HomeMy WebLinkAboutR-1766 - Granting a utility variance for Douglas Snavely for property located at 14208 23rd Avenue NE Arlington WashingtonCITY OF MARYSVILLE Marysville,Washington RESOLUTION No./7~h A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR DOUGLAS SNAVELY FOR PROPERTY LOCATED AT 14208- 23RD AVENUE N.E., ARLINGTON,WASHINGTON. WHEREAS,on October 11,1995 DOUGLAS SNAVELY applied for a utility variance for one (1)water connection without sewer for property located outside of the City's RUSA boundary but within the CWSP at 14208-23rd Avenue N.E.,Arlington,Washington;and WHEREAS,on October 23,1995 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is within the area defined by the City's Coordinated Water System Plan. 2.The applicant has a shallow,hand-dug well which is easily contaminated by surface contaminants.The well has been tested and results indicate coloforms are present,making the water unsafe for drinking. 3.The property is located outside of the City limits, RUSA boundary,and Urban Growth Boundary,however it is within the CWSP.There is a 12-inch water main in 23rd Avenue.No sewer is available. 4.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 5.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 6 . enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 7.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use,which is for a single-family residence. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: RESOLUTION -1 Imv/snavely.res 1.The variance for the applicant's connection to City water is hereby granted subject to the following conditions: a.The applicant shall sign a covenant not to protest annexation of applicant's property to the City of Marysville. b.The applicant's connection to the City water shall be with the express understanding that there is the possibility of low water pressure in this vicinity and that any boosting of pressure shall be at the sole expense of the applicant. c.The variance shall be granted on the condition that the water service shall be for the applicant's single- family residence only and no other properties or uses shall be served thereby. 2.Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~PASSED by the City Council and APPROVED by the Mayor this I~~day of November,1995.
