HomeMy WebLinkAboutR-1778 - Granting a variance for property owned by John and Suzette Nielson subject to conditions,--------------------------- • CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./778 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A VARIANCE FOR PROPERTY OWNED BY JOHN AND SUZETTE NIELSON SUBJECT TO CONDITIONS. WHEREAS,John and Suzette Nielson own certain real property located north of 74th Place N.E.,west of 49th Drive N.E.,south of 75th Place N.E.,and east of 48th Avenue N.E.in the City of Marysville;and WHEREAS,the applicant has sought a variance from Section 19.20.070(c)of the Marysville Municipal Code relating to residential use of substandard lots;and WHEREAS,John and Suzette Nielson applied to the City for a variance to construct one single-family residence on an existing lot which is less than 5,000 square feet in size;and WHEREAS,the City Hearing Examiner held a public hearing on November 30,1995 and adopted Findings of Fact,Conclusions and a Recommendation approving the variance subject to five (5) conditions;and WHEREAS,the City Council held a public meeting on said variance on January 2,1996 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON 'AS FOLLOWS: 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced variance under File No.PA 9510053 is hereby approved. 2.The variance for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of any of the conditions of said decision may result in revocation of the variance or enforcement action being brought by the City. 3.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by Writ of Certiorari,Writ of Prohibition,or Writ of Mandamus within fifteen (15)calendar days after the passage of this resolution.
