LOCATED SOUTH OF 132ND STREETN.E. AND EAST OF 56TH AVENUE N.E., MARYSVILLE,WASHINGTON. WHEREAS,on January 2,1996 Belmark Industries,Inc.applied for a utility variance for 153 water connections and 153 sewer connections for property located south of 132nd Street N.E.and east of 56th Avenue N.E.,Marysville,Washington,for property located outside of the City's RUSA boundary;and WHEREAS,on January 22,1996·the City Council of the City of Marysville held a public meeting concerning the variance application,and made the following findings: 1.The applicant's property is within the area defined by the City's Coordinated Water System Plan. 2.The applicant's property is near but not within the City's RUSA boundary and is fronted by a sanitary sewer main in 132nd Street N.E.,and a water main presently services three adjacent developments off of 132nd Street N.E.However,the water main may need to be upsized and looped to serve the applicant's property. 3.The applicant's property is within the Urban Growth Boundary. 4.The applicant's request is consistent with the long range sewer and water utility planning efforts of the City of Marysville. 5.Connection to City utilities will not adversely affect the existing sewer collection system and water system,so long as the necessary upsizing and proper development standards are met. 6.The above circumstances constitute exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 7. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. RESOLUTION - 1 Imv/belmark.res ..,.',",," 1 .;;.... 8.The authorization of the variance will not be materially detrimental to the public interest,welfare or the environment. 9.The granting of the variance will not be inconsistent with the long range plans of the City utility system,or jeopardize utility availability for properties within the City limits. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: The variance for the applicant's 153 connections to City sewer and water is hereby granted subject to the condition that the applicant shall upsize and loop the existing water main if, in the discretion of the City's consulting engineer,said upsizing and looping is necessary and appropriate.This variance shall also be conditioned upon the applicant providing an adequately sized stub for utility services to the south of its property. Any party aggrieved by this resolution shall have the right to file an application for a writ of certiorari in Snohomish County Superior Court;PROVIDED,that the application must be filed and served within 20 days of the date of this resolution. ~PASSED by the City Council and APPROVED by the Mayor this5""day of February,1996.
