RESOLUTION NO.178'/
A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A CONDITIONAL
USE PERMIT AND VARIANCE FOR PROPERTY OWNED BY STEVE MULLER
SUBJECT TO CONDITIONS.
WHEREAS,Steve Muller owns certain real property located
south of 52nd street N.E.,east of Sunnyside Bldv.,west of 66th
Avenue N.E.,and north of 44th Street N.E.in the City of
Marysville;and
WHEREAS,Meta Halliday applied to the City for a Conditional
Use Permit to construct one duplex on an existing lot;and
WHEREAS,the City Hearing Examiner held a public hearing on
January 11,1996,and adopted Findings of Fact,Conclusions and a
Recommendation approving the Conditional Use Permit and variance
subject to seven (7)conditions;and
WHEREAS,the City Council held a public meeting on said
Conditional Use Permit and variance on February 12,1996 and
concurred with the Findings of Fact,Conclusions and
Recommendation of the Hearing Examiner;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Conditional Use Permit under File No.PA 9511055 is hereby
approved.
2.The Conditional Use Permit and variance for the above-
described property shall be perpetually conditioned upon strict
compliance with each of the conditions set forth in the
Recommendation of the Hearing Examiner.Violation of any of the
conditions of said decision may result in revocation of the
Conditional Use Permit and variance or enforcement action being
brought by the City.
3.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by Writ of Certiorari,Writ of Prohibition,or
Writ of Mandamus within fifteen (15)calendar days after the
passage of this resolution.
