A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR BERTST. JEAN FOR PROPERTY LOCATED AT 2832 -169TH
STREETN.E., ARLINGTON,WASHINGTON.
WHEREAS,on December 22,1995 BERT ST.JEAN applied for a
utility variance for one water connection and two sewer
connections for property located at 2832 -169th Street N.E.,
Arlington,Washington;and
WHEREAS,on February 26,1996 the City Council of the City
of Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant has requested one water connection and
two sewer connections for property located outside the RUSA
boundary but within the CWSP and Urban Growth boundary.
2.The property is located at 2832 -169th Street N.E.,
Arlington,adjacent to the west side of the pending Arlington
annexation,but not within the annexation area.
3.A twelve-inch cast iron water main is located in 169th
Street N.E.which fronts the applicant's property.A twelve-inch
PVC sewer main is located in 169th Street N.E.and also fronts
the applicant's property.
4.The applicant is requesting a separate water meter to
serve a mobile home that is presently being serviced by a water
meter serving an existing house.The applicant has an existing
septic system on the property;however,the Snohomish County
Health District has conducted an on-site evaluation of the system
and has determined that there is inadequate depth of soil above
the seasonal groundwater table to meet the minimum requirements
of WAC 246-272.A letter dated December 20,1995 by the Health
District documents this situation.
5.The applicant has not signed any petition to annex to
another jurisdiction.
6.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
7.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
9.The granting of the variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as the utility connections are limited to one
water connection for a single-family residence and two sewer
connections for two single-family residences.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's request for one water
connection and two sewer connections is hereby granted subject to
the following conditions:
a.The applicant comply with all requirements of MMC
14.32,including the execution of a covenant agreeing not to
protest annexation to Marysville;
b.The applicant pay all fees and charges required by
ordinance.
2.Any party aggrieved by this resolution shall have the
right to file an application for a writ of certiorari in
Snohomish County Superior Court;PROVIDED,that the application
must be filed and served within 20 days of the date of this
resolution .
