HomeMy WebLinkAboutR-1799 - Affirming the decision of the hearing examiner and approving a variance from section 19.20.070 ( c ) of the Marysville Municipal Code relating to theCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.17?'t A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE DECISION OF THE HEARING EXAMINER AND APPROVING A VARIANCE FROM SECTION 19.20.070(cl OF THE MARYSVILLE MUNICIPAL CODE RELATING TO THE RESIDENTIAL USE OF SUBSTANDARD LOTS. WHEREAS,Belmark Industries applied for a variance from Section 19.20.070(c)of the Marysville Municipal Code relating to the residential use of substandard lots to allow for the construction of two single-family residences on two lots of less than 5,000 square feet in size;and WHEREAS,on March 14,1996 the City Hearing Examiner held a public hearing on said variance and adopted Findings of Fact, Conclusions and a Recommendation approving the variance,subject to seven (7)conditions;and WHEREAS,the City Council held a public meeting on said variance on April 22,1996 and concurred with the Findings of Fact,Conclusions and Recommendation of the Hearing Examiner; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced variance under File No.PA 9602008 is hereby approved. 2.The variance for the above-described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of said decision may result in revocation of the variance or enforcement action being brought by the City. 3.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. ~PASSED by the City Council and APPROVED by the Mayor this~v~day of May,1996.
