J CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.j~/,f A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE DECISION OF THE HEARING EXAMINER FOR THE PRELIMINARY PLAT, SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT, STREET VARIANCE AND SEPA APPEAL FOR THE ANDERSON INDUSTRIAL PARK. WHEREAS,ERNEST (BUD)ANDERSON applied for preliminary plat approval,shoreline substantial development permit,and street variance for property generally located on the east side of 47th Avenue N.E.street alignment,south of the terminus of the existing public right of way;and WHEREAS,a SEPA appeal was filed that was consolidated with the hearing on the merits of the above-referenced action;and WHEREAS,on July 11,1996 the Hearing Examiner held a public hearing on the above-referenced application and SEPA appeal and adopted findings of fact,conclusions,and a recommendation approving the preliminary plat,shoreline substantial development permit and street variance,and upholding the subject SEPA appeal,subject to ten conditions;and WHEREAS,the Marysville City Council held a public meeting on August 26,1996 and concurred with the findings of fact, conclusions and recommendation of the Hearing Examiner; NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: Section 1.The findings of fact,conclusions and recommendation of the Hearing Examiner with respect to the above- referenced applications and SEPA appeal are hereby AFFIRMED. Section 2.The above-referenced approvals shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the recommendation of the Hearing Examiner.Violation of any of the conditions of said decision may result in revocation of the above-referenced approvals and/or in enforcement action being brought by the City. Section 3.This decision shall be final and conclusive with the right of appeal by land use petition under the LAND USE PETITION ACT in Snohomish County Superior Court;provided,that the petition must be filed and served on all necessary parties within twenty-one (21)days of the date of this resolution.
