A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR LEROY AND VALERIE TANIS FOR PROPERTY LOCATED AT
6918 - 1OOTH STREET N.E., MARYSVILLE,WASHINGTON.

WHEREAS,on September 9,1996 Leroy and Valerie Tanis
applied for a utility variance for one water connection without
sewer and/or deferral of the frontage requirement for utility
main charge for property located 6918 -lOath Street N.E.,
Marysville,Washington;and
WHEREAS,on September 23,1996 the City Council of the City
of Marysville held a public meeting concerning the variance
application and made the following findings:

The applicant provided evidence that their well has

2.By letter dated September 9,1996,which is
incorporated by this reference,the applicant's accountant,Phil
Kazen,provided supplemental information showing evidence of a
bona fide hardship.
3.The general area of the applicant's property could
experience abnormal water pressures due to its proposal to
connect to the water transmission main.
4.The property is within the City'S Critical Water Study
Plan (CWSP)area.
5.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
6.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
8.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City

limits,so long as this utility connection is limited to the
current use,which is one single-family residence.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to one
water connection without sewer and/or deferral of the frontage
requirement for utility main charge is hereby granted subject to
the following conditions:
a.The utility variance shall be to serve the
existing single-family residence only.
b.The applicant shall sign a hold harmless agreement
indemnifying the City for any claims or damages resulting
from connection to the City's water main.
c.The applicant will install a pressure-reducing
valve at their own expense.
d.The utility main charge may be deferred until the
applicant's property is developed for any purpose other than
remodel of the existing single-family residence.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
