CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./8'2..q A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE STILLAGUAMISH SENIOR CENTER FOR PROPERTY LOCATED AT 18308 SMOKEY POINT BLVD., ARLINGTON,WASHINGTON. WHEREAS,on July 31,1996 The Stillaguamish Senior Center applied for a utility variance for one sewer and one water connection for property located 18308 Smokey Point Blvd., Marysville,Washington;and WHEREAS,on August 26,1996 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is presently served by Marysville sewer and water,and the applicant wishes to add 30 units of senior housing at the Stillaguamish Senior Center campus. 2. utility City of The applicant applied to the City of Arlington for services,but was unable to obtain a commitment from Arlington. the 3.While the applicant's property is not within the RUSA, the CWSP boundary or the urban growth boundary,there is an 8- inch ductile water main on site and a private pressure system to the City's force main on Smokey Point Blvd.with a 4-inch connection to the public system. 4.The applicant's project will provide 30 units of senior housing,for which there is a critical need. 5.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 6.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 7. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 8.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City RESOLUTION - 1 /wpf/rrrv/ssc.res J limits,so long as this utility connection is limited to use for thirty (30)units of senior housing. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to service outside of RUSA is hereby granted subject to the condition that the applicant comply with all applicable provisions of the Marysville Utility Code including,but not limited to,the provisions of MMC Chapter 14.32. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. q ~PASSED by the City Council and APPROVED by the Mayor this day of December,1996.
