A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR ROD FORSBERG FOR PROPERTYLOCATED AT 5505 -10BTH
STREET N.E.,MARYSVILLE,WASHINGTON.
WHEREAS,on January 3,1997 ROD FORSBERG applied for a
utility variance for one (1)water connection without sewer for
property outside the City's RUSA boundary located at 5505 -lOath
Street N.E.,Marysville,Washington;and
WHEREAS,on January 27,1997 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.There is an eight-inch water main in lOath Street N.E.,
and eight-inch PVC sewer main in lOath Street N.E.
2.The applicant has an existing septic system which has
failed and is in close proximity to the existing well causing a
possible health hazard.Snohomish County Health District did
conduct an on-site inspection and will grant approval of a septic
repair providing the applicant connects to City water.
3.The applicant is requesting one water connection only
off an easement he has on lOath Street N.E.,and as the private
service line exceeds 500 feet from the City's water main,he is
also requesting a variance from MMC 14.03.060.
4.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
5.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
7.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is single-family residential.

NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
water without sewer for property located outside of the City's
RUSA boundary and for a connection that is greater than 500 feet
from the City's sewer main is hereby granted subject to the
following conditions:
a.The applicant shall meet and confer with City
staff on the feasibility of making the water connection at
an alternative site.
b.The applicant shall comply with all applicable
provisions of the City Utility Code including,but not
limited to,execution of an annexation covenant and payment
of all utility main charges and other applicable fees.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
