A RESOLUTION OF THE CITY OF MARYSVILLE DECLARING ITS INTENTION TO INITIATE THE FORMATION OF LOCAL IMPROVEMENT DISTRICT NO. 67 TO CARRY OUT THE SYSTEM OR PLAN OF ADDITIONS TO AND BETTERMENTS AND EXTENSIONS OF THE WATERWORKS UTILITY OF THE CITY,INCLUDING THE SYSTEM OF SEWERAGE AS A PART THEREOF,AS ADOPTED BY ORDINANCE NO. 937 TO SERVE CERTAIN AREA OF THE CITY,ALL AS APPLICABLE TO SUCH LOCAL IMPROVEMENT DISTRICT;AND FIXING THE DATE,TIME,AND PLACE FOR A PUBLIC HEARINGON THE FORMATIONOF THE PROPOSED LOCAL IMPROVEMENT DISTRICT. WHEREAS,the City of Marysville,Washington (the "City"),by Ordinance No. 385 passed September 2, 1952,combined the sewerage system of the City and all additions and improvements thereto with the waterworks utility of the City,and the sewerage system at all times since has been considered a part of and belonging to the waterworks utility of the City,and the words "waterworks utility of the City"hereinafter shall mean the combined sewerage system and water system of the City, together with all additions thereto and betterments and extensions thereof hereafter made; and WHEREAS,pursuant to Ordinance No. 937 passed July 9,1979,the City Council in adopting the Lower Snohomish River Basin Waste Water Facilities Planning Study for the Marysville Subregion specitied and adopted a system or plan of additions to and betterments and extensions of the waterworks utility of the City;and WHEREAS,the City Council has determined it to be in the best interests of the City that a portion of such system or plan of additions to and betterments and extensions of the waterworks utility of the City be undertaken and that a local improvement district be formed within the area hereinafter more particularly described;NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,AS FOLLOWS: Section 1. It is the intention of the City Council of the City to order the acquisition and construction of the portion of the system or plan of additions and betterments and extensions of the \worf(ing\mv\reso0626.doc ." ------_._---------------------------, i'.', waterworks utility of the City as adopted by Ordinance 937passed by the City Councii and approved by the Mayor on July9,1979,to serve a certain area of the City and applicable to the proposed local improvement district hereinafter described.The nature and territorial extent of such proposed improvements consist of the construction and installation of 1,200 lineal feet of 8-inch sewer main and appurtenances along 92nd Place N.E.from 58th Drive N,E.to a point approximately 80 feet east of 55th Avenue N.E. Section 2. To carry out the foregoing system or plan of additions and betterments and extensions of the waterworks utility of the City, there shall be formed a local improvement district to be known and designated as local Improvement District No. 67 of the City of Marysville, Washington, the boundaries of which are described in ExhibitA attached hereto and incorporated herein by this reference. Section 3. The estimated cost and expense of the portion of the systemor plan of additions to and betterments and extensions of the waterworks utility of the City applicable to LID No. 67is declared to be approximately $303.960.00,and shall be borne by and assessed against the property included within proposed LID No. 67.which district embraces as nearly as practicable all property specifically benefitted by such improvements.The assessments in that local improvement district shall be for the sole purpose of paying the cost and expense of the improvements or for payment into the Water and Sewer Revenue Refunding Bond Fun~1977.in the event that water and sewer revenue bonds hereafter are authorized to be issuedto pay for all or a part of the improvements in LID No. 67 and such bonds are issuedon a parity of lien with the outstanding bonds payable out of such fund or, if not issuedon a parity of lien therewith.for payment into a special bond redemption fund hereafter created for the payment of water and sewer revenue bonds hereafter authorized to be issued by the City to provide the funds required to pay all or a part of the cost and expenses of carrying out such systemor plan. Section 4. In accordance with the provisions of RCW 35.44.047,the City may use any method or combination of methods to compute assessments which may be deemed to fairly reflect the special benefits to the properties being assessed. Section 5. A public hearing on the formation of LID No. 67shall be held in the Council Chambers at 1635 Grove Street, Marysville,Washington.at 7:00p.rn.,local time, on August 4,1997,at a regular meeting of the City Council then to be held at such time and place. \wor1::ing\mv\reso0626.doc ·'.j ... Section 6. TheCity Clerk is authorized and direcfed to give nofice of fhe adopfion of this resolufion and of the dote.time.and place fixed for the public hearing to each owner or reputed owner of any lot.tract.parcel of land.or other property within the proposed local improvement district by mailing such notice at least fifteen (15)days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon,as required by law. TheCity Clerk also is authorized and directed to give notice of the adoption of thisresolution and of the date.time.and place fixed for the public hearing to each owner or reputed owner of any lot,tract.parcel of land.or other property outside of the proposed local improvement district that is required by the Federal Housing Administration as a condition of loan qualification to be connected to the proposed improvements.by mailing such notice at least fifteen (15)days before the date fixed for the public hearing to the owner or reputed owner of the property as shown on the rolls of the County Assessor at the address shown thereon,as required by law. Section 7. Larry R.Wade of Hammond,Collier &Wade - Livingstone Associates, Inc..the City's consulting engineer.is directed to submit to the City Council on or prior to July28,1997.all data and information required by law to be submitted. 1997.
