A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR RICHARD LINDBLOM FOR PROPERTY LOCATED AT 5002 -
B4th Street N.E., MARYSVILLE, WASHINGTON.
WHEREAS,on April 16,1997 RICHARD LINDBLOM applied for a
utility variance for sewer and water for property located 5002 -
84th Street N.E.,Marysville,Washington;and
WHEREAS,on May 27,1997 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant has submitted an application for a
utility commitment letter for three water connections and five
sewer connections for the property located at 5002 -84th Street
N.E.,Marysville,Washington.On March 20,1997,the Director of
Public Works provided a utility commitment letter.
2.The applicant has applied for a variance from the
frontage requirements provided in MMC 14.03.300.
3.The property has frontage on 84th Street N.E.for
ingress and egress only.There is an existing eight-inch PVC
sewer line at the property's southern boundary adjacent to the
Plat of Pinewood Place.
4.The length along 84th Street N.E.to extend the sewer
would be approximately 1,000 feet at a depth of 10 to 14 feet,
which would require extensive dewatering during construction.
5.The applicant is requesting to connect to the existing
sanitary sewer main in the Plat of Pinewood Place in lieu of
extending a new main along 84th Street N.E.
6.It is estimated that it would cost approximately
$75,000 to extend the sewer line along 84th Street N.E.
7.The property is located within the City's RUSA,CWSP
and Urban Growth boundaries.
8.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
9.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the

same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
11.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is one single-family residence and two
duplexes.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance from MMC 14.03.300 is hereby GRANTED
subject to the following conditions:
a.The applicant,prior to utility service,shall
execute an annexation covenant in favor of the City for each
of the lots to be served by Marysville utilities.
b.Prior to connection to City utilities,the
applicant shall sign an agreement with the City committing
not to protest the formation of an LID or ULID for extension
of the sewer main along 84th Street N.E.and/or to pay the
recovery fees or assessments in the event the sewer main is
extended privately through a sewer recovery agreement.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
