CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO. /'i(S '" A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR THE MARYSVILLE SCHOOL DISTRICT FOR PROPERTY LOCATED AT 5611 -lOaTH STREET N.E., MARYSVILLE,WASHINGTON. WHEREAS,on July a,1997 the Marysville School District applied for a utility variance for one water service and three sewer services for property located outside the City's RUSA boundary and a variance from the frontage requirements of MMC 14.03.300 on lOath Street N.E.for property located at 5611 - lOath Street N.E.,Marysville,Washington;and WHEREAS,on July 2a,1997 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The subject property is within the City's CWSP boundary and the City's Urban Growth boundary. 2.The property is outside of the City's RUSA boundary; however,the subject property,which is a high school,is currently being served by both Marysville water and sanitary sewer. 3.The application consists of a.request for one additional water service and three sewer services to accommodate a remodel and addition to the high school campus.The subject remodel and addition are for a public facility and are urgently needed to accommodate the rapidly increasing student enrollment in the area. 4.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 5.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 6 . enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 7.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City RESOLUTION - 1 Imv/schdist.res limits,so long as this utility connection is limited to the current use,which is a public high school. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to one water service and three sewer services is hereby granted subject to the following conditions: a. as-builts lines. That the applicant provide and submit easements/ on the existing,original water and sanitary sewer b.That the applicant execute and provide the City with an annexation covenant as required by MMC 14.32.040. c.That the applicant execute a covenant for connection to Marysville utility system,power of attorney, and agreement not to protest formation of local improvement district and/or to participate by private recovery agreement. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. dZPASSED by the City Council and APPROVED by the Mayor this I{~\day of August,1997.
