HomeMy WebLinkAboutR-1864 - Finding that all properties within Local Improvement District No. 64 should be assessed for special benefits resulting from street improvements, inclu....'"ii '.9-,~ -_._------------------- ;----.-/~ CITY OF MARYSVILLE, WASHINGTON RESOLUTION NO.I Rbi A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON, FINDING THAT ALL PROPERTIES WITHIN LOCAL IMPROVEMENT DISTRICT NO. 64 SHOULD BE ASSESSED FOR SPECIAL BENEFITS RESULTING FROM STREET IMPROVEMENTS, INCLUDING THE PLAT OF CLOVERDALE, DIVISION 1, FIXING A TIME AND PLACE FOR HEARING ON THE FINAL ASSESSMENT ROLL FOR THAT LOCAL IMPROVEMENT DISTRICT, AND DIRECTING THAT NOTICE THEREOF BEGIVEN IN THE MANNER REQUIRED BY LAW TO ALL PROPERTY OWNERS OF RECORD. WHEREAS, Local Improvement DistrictNo. 64 (the "LID") was created and established by Ordinance No. 2016, passed by the City Council on February 27, 1995; and WHEREAS, the City Council is of the opinion that all lots, parcels or tracts of land benefited by the improvements in the LID and located withinthe legal description of the territory of the LID as described in Ordinance No. 2016, including those properties located within the Plat of Cloverdale, Division 1 (the "Cloverdale Properties"), should be assessed for the special benefits resulting from street improvements made in the LID; and WHEREAS, the final assessmentroll for the LID has been prepared as provided by law and is on file with the City Clerk, and includes the Cloverdale Properties, and it is necessary to fix the date for a hearing thereon; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON, as follows: 0310832.01 -1-, Section 1. The public hearing on the final assessment roll for the LID,including the Cloverdale Properties which after due consideration it is found should be assessed, will be held before the City Council at 7 p.m.,local time, in the Council Chambers, in the Public Safety Center at 1635 Grove Street, Marysville, Washington on December 8, 1997. Assessments against the Cloverdale Properties shall be in accordance with the benefits accruing to such properties by reason of the improvementsand in proportion to the assessments levied upon other property in the LID to be determined in all cases pursuant to the zone-and-termini method described in RCW 35.44.030 which the Council believes to be fair, equitable and lawful. The City Clerk is instructed to cause proper notice to be given both by mailing to all property owners in the LID as shown on the records of the County Treasurer, and by publication as required by law, notifying all who may desire to object to their proposed assessments to file written protests and appear at the hearing and present their objections with any supporting information or evidence. Section 2. At or prior to the date fixed for the hearing on the final assessment roll for the LID and the assessment of all properties therein, the Public Works Director or his designee shall report to the City Council regarding the amount which should be borne by each lot, tract or parcel of land on the final assessment roll including the Cloverdale Properties. 0310832.01 -2- ·,-.'""..~~.,,*,\...;.
