HomeMy WebLinkAboutR-1871 - Granting a utility variance for Grandview Inc. for property located at 3200 186th Place NE Marysville Wa.- CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./87 ( A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR GRANDVIEW, INC.FOR PROPERTY LOCATED AT 3200 - 186TH PLACE N.E., MARYSVILLE,WASHINGTON. WHEREAS,on November 19,1997 GRANDVIEW,INC.applied for a utility variance for 33 water connections and no sewer connections for property located at 3200 -186th Place N.E., Marysville,Washington;and WHEREAS,on January 5,1998 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's property is outside the Marysville city limits,the City's RUSA boundary,the Marysville Coordinated Water Service Area and the City's Urban Growth Boundary. 2.The applicant's property is within the City of Arlington Coordinated Water Service Area boundary. 3.Marysville utilities has a 10-inch cast iron water main in Smokey Point Boulevard and an 8-inch ductile iron water main in 31st Avenue N.E.,Timber Park.No sewer gravity is available within 200 feet. 4.The applicant has provided the City with a letter from the City of Arlington dated October 16,1997 which declines water service at this time and which makes reference to the future transfer of the above-referenced utility lines.Said letter is incorporated herein by this reference. 5.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 6.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 7. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 8.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City RESOLUTION - 1 /wpf/rnv/grandview.res ,, • /'~. • limits,so long as this utility connection is limited to the current use,which is single-family residential. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to city water without sewer is hereby granted subject to the following conditions: a.That the applicant comply with all provisions of the City's Utility Code. b.That the applicant be responsible for paying all appropriate fees to the City of Marysville unless the water lines to which the applicant's project is connected are owned by the City of Marysville at the time of the applicant's connection. c.That the applicant comply with all City of Marysville requirements relating to the extension of the utility lines to cover the frontage of the applicant's property. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution.
