A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR PETE POESCHEL FOR PROPERTY LOCATED AT 18223
SMOKEY POINT BOULEVARD,ARLINGTON.WASHINGTON.
WHEREAS,on October 13,199j fece Poeschel applied for a
utility variance for one water connection without sewer for
property located 182:<:3 Smokey Point.Boulevard,Arlington,
Washington;and
WHEREAS,on November 24,J.997 the Cit:.y Council of the City
of Marysville held a public me.et i.nq corice rn i nq the variance
application and made the folJ.owing findings:
1.The applicant's property is outside the city limits,
RUSA boundary,Marysville CWSP,and Marysville Urban Growth
boundary.
2.The property is within Arlington's Coordinated Water
Service Area.
3.The applicant's property fronts the water main in 183rd
Place N.E.and 36th Avenue N.E.
4.While there is an existing well on site,however,the
Department of Health has determined that the water is
unsatisfactory.
5.By letter dated October 14,1997,the City of Arlington
has indicated that it is presently unable to provide service to
the applicant's property.Said letter is hereby incorporated hy
this r'e f e r erice .
6.In lignt of the above-referenced f i.nd i.nq s ,the
authorization of the variance will not be me t e ri a Ll.y detrimental
to the public interest,welfare,or the envircnment.
"I The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applylng to the subject
property that do not apply generally to other propertles in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owne r s of other propert ies in the same vicinity.
9.The granting of a vari.ance in thi s case will not be
inconsistent with the long-range plans of the City utility system

or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is one single-family residence on 3.5 acres.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to city
water without sewer is hereby granted subject to the following
conditions:
a.That the applicant meet all requirements of the
City's Utility Code as set forth in MMC Chapter 14.32.
b.That applicant meet all City Code requirements for
covering the frontage of his property.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
