HomeMy WebLinkAboutR-1873 - Granting a utility variance for Robert and Cindy Allred for property located at 11624 55th Ave NE Marysville WaCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.jG;7.3 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR ROBERT AND CINDY ALLRED FOR PROPERTY LOCATED AT 11624 -55TH AVENUE N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on January 13,1998 Robert and Cindy Allred applied for a utility variance for one (1)water connection and no sewer connection,and for a variance deferring coverage of the applicant's frontage as required by MMC 14.03.300 for property located at 11624 -55th Avenue N.E.,Marysville,Washington;and WHEREAS,on January 26,1998 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The property is not within the Marysville city limits. 2.The property is within the City's RUSA boundary,CWSP boundary,and urban growth boundary. 3.There is an 8-inch ductile water main on 55th Avenue N.E.at the north end of the applicant's property.Pursuant to MMC 14.03.300,the applicant would be required to extend the water main approximately 80 feet in order to cover the frontage of their property.However,the City has plans to loop the system (connecting existing main in 55th Avenue to existing main in 116th)during the summer of 1998. 4.Results of two water samples taken by the Snohomish Health District indicate high levels of nitrate and the water from bacteriological analysis result was "unsatisfactory-- coliforms present.".The letter from the Snohomish Health District to the applicant dated December 18,1997 is incorporated by this reference. 5.The applicant has been informed of the estimated cost for the City to extend their water main to cover their frontage. The estimated cost is $2,000.The applicant acknowledged on the public record of the January 26,1998 City Council meeting that they are willing to pay a utility main charge in the sum of $2,000 for the City to install an 8-inch main this summer. 6.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 7.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject RESOLUTION - 1 /mv/allred.res s: property that do not apply generally to other properties in the same vicinity. 8 . enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 9.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use,which is single-family residential. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to one water connection is hereby granted subject to the following conditions: a.That prior to connection to City water,the applicant pay to the City a utility main charge in the sum of $2,000, b.That the applicant pay all applicable fees and charges as required by City ordinance. c.That both the applicant and the purchaser of their property execute an annexation covenant as required by MMC 14.32.040. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. f1 PASSED by the City .?-n~day of Ed.""Cl'J Council and APPROVED by the Mayor this ,1998.
