A RESOLUTION OF THE CITY OF MARYSVILLE DENYING WITHOUT
PREJUDICE AN APPLICATION FOR UTILITY VARIANCE BY TONY AND
MAUREEN SITZ FOR PROPERTY LOCATED AT 5008 - 73RD DRIVE N.E.,
MARYSVILLE,WASHINGTON.
WHEREAS,on March 5,1998 Tony and Maureen Sitz applied for
a utility variance for one sewer connection without covering
their frontage pursuant to MMC 14.03.300 for property located at
5008 -73rd Drive N.E.,Marysville,Washington;and
WHEREAS,on March 23,1998 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant applied for a utility variance for one
sewer connection without covering their frontage pursuant to MMC
14.03.300.
2.The applicant is served by city water.
3.The applicant's property is within the Marysville city
limits,the RUSA boundary,the CWSP boundary and the City's Urban
Growth boundary.
4.The applicant's existing drainfield is operational and
is located on the southerly portion of their lot.The purpose
for the requested sewer connection is so that the applicant can
build a garage on a portion of the lot which serves as their
existing drainfield.
5.There is an eight-inch sewer main stubbed out of a
manhole in 73rd Drive N.E.to the northeast corner of the
applicant's lot.Compliance with MMC 14.03.300 would require
that the sewer main be extended to the south property line of the
applicant,which is approximately 100 lineal feet.
6.The above findings do not constitute exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is not necessary for the preservation
of a substantial property right of the applicant
by owners of properties in the same vicinity.

8.The grant of the variance would be inconsistent with
the long-range plans of the City utility system,as there would

be other properties requiring sewer service to the south of the
applicant,and therefore,the coverage of the applicant's
property should be required.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
The applicant's request for a utility variance from the
provisions of MMC 14.03.300 is hereby DENIED without prejudice.
The applicant may research the feasibility of forming an LID or
ULID or other options that would result in coverage of their
frontage.Based on such research,the applicant may request
reconsideration of the utility variance for a period of six
months from the date of this resolution without being required to
reapply for a variance or pay the application fee.
