A RESOLUTION OF THE CITY OF MARYSVILLE DENYING WITHOUT
PREJUDICE A UTILITY VARIANCE FOR WILLIAM M. CROSS, SR. FOR
PROPERTY LOCATED AT 11825 -44TH AVENUE N.E., MARYSVILLE,
WASHINGTON.
WHEREAS,on May 4,1998 William M.Cross,Sr.applied for a
utility variance for two water an~two sewer connections without
covering the applicant's frontage as required by MMC 14.03.300
with sanitary sewer main for property located at 11825 -44th
Avenue N.E.,Marysville,Washington;and
WHEREAS,on May 26,1998,the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The property is within the City's RUSA,CWSP and Urban
Growth boundaries.The property is not within the City limits or
within a ULID.
2.The applicant seeks permission to install a temporary
pressure sewer system to service a proposed three-lot short plat.
The system would discharge into a gravity system that will be
installed for the Lloyd short plat on 120th Street N.E.,
approximately 400 feet north of the applicant's property.
3.The subject property fronts on a water main but not a
sewer main.The existing home is connected to City water.
4.The City is currently preparing a preliminary design of
a gravity sanitary sewer system to serve the area of the
applicant's property.The City has also received numerous
signatures supporting the formation of an LID to bring gravity
sewer to the vicinity of the applicant's property.It is likely
that the LID will proceed once the preliminary design is
completed and the gravity service boundary is defined.
5.In light of the above-referenced findings,the granting
of the variance at this time would be inconsistent with the long
range plans of the City utility system,and the provision of
utility connections for new construction does not constitute
extraordinary or exceptional circumstances that would justify the
installation of a temporary pressure sewer system,given the fact
that provisions for a permanent gravity sanitary sewer system are
in progress.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:

1.The applicant's variance is hereby denied without
prejudice.
2.Within one year from the date of this resolution the
applicant may reapply,if necessary,for a utility variance
without paying the necessary application fee.
3.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage or-this resolution.
