A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FORDON AND NORMA THOMPSON FOR PROPERTY LOCATED AT
13711 -58TH DRIVE N.E.,MARYSVILLE,WASHINGTON.
WHEREAS,on May 6,1998 Don and Norma Thompson applied for a
utility variance for one water connection and no sewer
connection,a water connection outside of the City's RUSA
boundary,and a variance from the frontage requirements of MMC
14.03.300 for property located 13711 -58th Drive N.E.,
Marysville,Washington;and
WHEREAS,on May 26,1998 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant's property is not within the City limits,
the City's RUSA or Urban Growth boundaries,but is within the
City's CWSP boundary.
2.There is an eight-inch ductile iron water main on 58th
Drive N.E.Sewer is not available at this time.
3.The applicant has had their well tested and the results
were unsatisfactory.Due to the amount of iron in their well
water,they have been required to purchase their drinking water.
The applicant's neighbors immediately to the north and south have
received utility variances from the City Council to connect to
Marysville public water.
4.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
5.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
7.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is single-family residential.

NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
water outside of the City's RUSA boundary is hereby granted
subject to the following conditions:
a.That the applicant,prior to receiving connection
to the City's sewer or water utility,pay the cost of
covering the frontage of their lot as required by MMC
14.03.300.
b.That the applicant provide,if requested by the
City,an easement for the future installation of an eight-
inch ductile iron water main fronting the applicant's west
property line.
c.That the applicant comply with all other
applicable provisions of Title 14 of the Marysville
Municipal Code.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
