A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR ANTHONY COOK FOR PROPERTY LOCATED AT 6315 -83RD
AVENUE N.E.,MARYSVILLE,WASHINGTON.
WHEREAS,on June 16,1998 Anthony Cook applied for a utility
variance for one (1)water connection and no sewer connection for
property located at 6315 -83rd Avenue N.E.,Marysville,
Washington;and
WHEREAS,on July 27,1998 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The property is not within the City limits,RUSA
boundary or Urban Growth Boundary;however,the property is
within the City's CWSP.
2.There is a 16-inch ductile iron water main on the south
side of 64th Street and a 12-inch ductile iron water main on the
west side of 83rd Avenue.However,due to the depth of the
existing main in 83rd,connection to the 16-inch main in 64th
Street would be preferred.
3.Sewer is not available to serve the applicant's
property.
4.The applicant has had his water tested and it was found
to be high in iron as well has having an unpleasant odor.The
applicant has indicated that he has been purchasing water for
drinking for the last few years.
5.The applicant has received an easement from his
neighbor to the north so that a water meter could be installed in
the right of way in SR 528.
6.With the completion of the new Highway 9 reservoir,
which is expected in August 1998,there will be approximately
40 psi available at the applicant's site.However,in the event
the water pressure is low,the owner may be required to install a
booster pump at his own expense.
7.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
8.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject

property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
10.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
current use,which is single-family residential.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
water is hereby granted subject to the following conditions:
a.In the event the water pressure to the applicant's
site is insufficient and requires installation of a booster
pump in order to increase pressure,said booster pump shall
be installed at the applicant's sole expense.
b.The applicant shall pay all applicable fees and
shall meet all requirements of MMC Title 14.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
