HomeMy WebLinkAboutR-1914 - Granting a utility variance for Celia Bergevin for property located at 16408 51st Ave NE Marysville Wa;;;'-..,-. ;;" I-~ i-~ CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO./1Ii A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FORCELIA BERGEVINFORPROPERTYLOCATED AT 16408 - 51ST AVENUE N.E.,MARYSVILLE,WASHINGTON. WHEREAS,on December 7,1998 Celia Bergevin applied for a utility variance for one (1)water connection for property located at 16408 -51st Avenue N.E.,Marysville,Washington;and WHEREAS,on January 4,1999 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.On December 7,1998 the applicant applied for a utility variance for one water connection,and no sewer connection,and for service outside the City's RUSA boundary. 2.The property is not within the City limits or the RUSA, CWSP and Urban Growth boundaries. 3.The applicant's property fronts a 12-inch water main on 51st Avenue,and a 21-inch sewer main,Trunk A,in 51st Avenue. As the property is located outside the UGA boundary,they would not be required to connect to City sewer. 4.The applicant had her well tested by the Department of Health,and the results came back unsatisfactory. 5.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 6.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 7.The variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by owners of other properties in the same vicinity. 8.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use,which is single-family residential. RESOLUTION - 1 /mv/bergevin.res ---------------------------------' NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to City water is hereby granted subject to the following conditions: a.That the connection be for one single-family residence only. b.That the applicant comply with all applicable provisions of the City's utility code. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. -b£PASSED by the City Council and APPROVED by the Mayor this 1~"day of January,1999.
