A RESOLUTION OF THE CITY OF MARYSVILLE DENYING A UTILITY VARIANCE
FOR BORSETH CONSTRUCTION FOR PROPERTY LOCATED AT 7316 - 51ST
AVENUE N.E., MARYSVILLE,WASHINGTON.
WHEREAS,on April 9,1999,applicant Borseth Construction
applied for a utility variance to waive the requirements of MMC
14.03.300,which requires a property owner to extend city utility
mains for the full public or private road frontage of any lot on
which the structure to be connected is located,included both
frontages of a corner lot;and
WHEREAS,MMC 14.03.300 allows a waiver of the utility
extension requirement if it can be shown that no future
expansions beyond the applicant's lot will occur;and
WHEREAS,the City's utility committee reviewed the utility
variance request on April 15,1999 and,along with the Public
Works staff,recommended denial of the request;and based upon
the City Council agenda bill dated April 26,1999 and the
attached exhibits,all of which are incorporated by this
reference;and
WHEREAS,on April 26,1999 the Marysville City Council held
a public meeting to consider the utility variance request and
hereby makes the following findings:
1.The summary statement set forth in the City Council
agenda bill of April 26,1999 and Exhibits 1 and 2 thereto
accurately state the facts relating to this application and are
hereby adopted by this reference as the findings of the City
Council.
2.In addition,the City Council finds that future
expansions beyond the applicant's property are anticipated in
51st Avenue N.E.and are budgeted and scheduled for construction
in the year 2000.
3.Granting of the variance would be inconsistent with the
long-range plans of the City utility system,as it would not
facilitate the planned sewer utility improvements in 51st Avenue
N.E.if the applicant were allowed to connect to his property
through alternate means and without extending sewer along the
frontage of this property.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:

Based upon the above findings,the applicant's request for a
variance from the provisions of MMC 14.03.300 is hereby DENIED.
This decision shall be final and conclusive with the right
of appeals by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
PASSED by the City Council and APPROVED by the Mayor this
