Cross Sr. for property located at 11825 44th Ave NE Marysville Wa" ---------------------- I-~ I-~ CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.1 B7 A RESOlUTION OF THE CITY OF MARYSVILLE DENYING A UTILITY VARIANCE FOR WILLIAM M.CROSS SR.FOR PROPERTY LOCATED AT 11825 -44TH AVENUE NE, MARYSVILLE,WASHINGTON. WHEREAS,on April 20,1999 William M.Cross Sr.applied for a utility variance from the provisions of MMC 14.03.300 to not cover his frontage for property located 11825 -44th Avenue N.E., Marysville,Washington;and WHEREAS,on June 28,1999 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant is requesting permission to install a temporary pressure system to service a proposed three-lot short plat.In May 1998,the applicant applied for a utility variance to not cover the frontage of his property as required by MMC 14.03.300.The variance was denied on May 26,1998 and pursuant to Resolution No.1890 which is incorporated by this reference, the City Council denied said variance request.Conditions since the original denial of the variance request have not changed. 2.The City has completed a preliminary design of a gravity sewer system to service the area of the applicant's property.As it is planned that a gravity sewer system will be installed to serve the area of the applicant's property in the future,and as the City's comprehensive sewer plan does not contemplate service to this area by a temporary pressure system, it is inappropriate to authorize such a system. 3.The information contained in the Council Agenda Bill of June 28,1999 is accurate and correct and the contents thereof are incorporated by this reference. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.Based upon the above-referenced findings,the applicant's variance is hereby denied. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution.
