A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE
FOR ART WILLIAMS JR.FOR PROPERTY LOCATED AT 6502 - 19TH AVENUE NE,
MARYSVILLE,WASHINGTON.
WHEREAS,on June lB,1999 Art Williams Jr.applied for a
utility variance for one water connection and no sewer connection
for property located at 6502 -19th Avenue N.E.,800 feet north
of Marine View Drive on the west side of 19th Avenue,Marysville,
Washington;and
WHEREAS,on June 28,1999 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant's variance is for one water connection
without sewer for property located outside the City's RUSA
boundary.The variance request is also for a waiver of the
frontage requirements of MMC 14.03.300 and waiver of the City's
annexation covenant requirement contained in MMC 14.32.040.
2.The applicant has been living on the premises since
July 1998 without water or a functioning septic system.He has
been buying drinking water and using a small camping trailer for
personal functions.
3.The applicant applied for a water connection to the
Tribes'water system through the Bureau of Indian Health Service.
Due to a pipe leak in the Tribes'system,a water connection at
the designed connection point is not available at this time.Due
to future construction of Marine View Drive,it is not feasible
or cost effective to make the required repairs to the Tulalip
line at this time.However,a repair project is tentatively
planned to be accomplished during the road widening project
scheduled for early 2001.
4.The Tulalip Tribes have future plans to construct an
eight-inch water main on the west side of 19th Avenue for a
distance of 3,000 feet to provide water to the applicant and
other affected homeowners.As a result,any connection to the
City water system would be considered temporary.
5.The City of Marysville has an existing eight-inch water
main along the east edge of right of way on 19th Avenue serving
Marysville west.The applicant is requesting a single temporary
connection to this main until the eight-inch water main to be
constructed by the Tulalip Tribes is complete.

authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
8.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
10.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is temporary and
limited to the current use,which is one single-family residence.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance'for the applicant's connection to one
water connection and no sewer connection,for service outside
RUSA and for waiver of frontage is hereby granted subject to the
following conditions:
a.The applicant's connection to water shall be on a
temporary basis until such time as the Tulalip Tribes have
repaired the existing water main or constructed a new water
main on the west side of 19th Avenue.When the new water
main is constructed,the applicant shall connect to the same
at his own expense.
b.The applicant pay all applicable fees and charges
set forth in MMC Title 14.
c.The applicant comply with all provisions of the
Marysville Municipal Code,with the exception of those
matters for which a variance or waiver is granted.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
