A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE
FOR DENNIS G. CARLSON FOR PROPERTY LOCATED AT 4629 -lOaTH STREET
N.E., MARYSVILLE,WASHINGTON.
WHEREAS,on January 3,2000 Dennis G.Carlson applied for a
utility variance for sewer and water connections for property
located at 4629 -100th Street N.E.,Marysville,Washington;and
WHEREAS,on January 24,2000 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The applicant is proposing a net density of 7 DU per
acre which exceeds the density authorized under the City's RUSA
Plan of 4.5 DU/acre.
2.The City of Marysville Comprehensive Sewer Plan
contemplates a density of 18 DU per acre.
3.The City's Sewer Comprehensive Plan and GMA Land Use
Comprehensive Plan densities were adopted after the City's RUSA
Plan and in the area of the applicant's property more accurately
reflect the City's anticipated densities.
4.The applicant's property is within the City's RUSA
boundary,CWSP boundary,and the City's Urban Growth boundary.

to the public interest,welfare,or the environment.

limits,so long as this utility connection is limited to the
current use,which is single-family residential.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
sewer and water is hereby granted subject to the following
conditions:
a.The densities proposed by the applicant shall be
consistent with the City's Sanitary Sewer Comprehensive Plan
designation for the property.
b.The applicant shall petition for annexation to the
City prior to connection to City utilities.
c.The applicant shall comply with all applicable
provisions of the Marysville Municipal Code including,but
not limited to,Chapter 14.32.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
