A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR JESSE A.PERRAULT FOR PROPERTY LOCATED AT 4930 -72ND DRIVE N.E., LOT 7,MARYSVILLE,WASHINGTON. WHEREAS,on April 3,2000 Jesse A.Perrault applied for a utility variance for one sewer connection and waiver of the frontage requirement of MMC 14.03.300 for property located 4930 - 72nd Drive N.E.,Lot 7,Marysville,Washington;and WHEREAS,on April 24,2000 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The property is within the City limits,RUSA,CWSP,and urban growth boundaries. 2.The single family residence at the above referenced address is located on a corner lot which fronts 72nd Drive NE and 49th Place NE.The Plat of Jefferson Hill is currently under construction and has completed the installation of the sanitary sewermain in 72nd Drive NE to 49th Place NE,and is scheduled to do paving within the next several weeks.There is also an existing sanitary sewer in 49th Place (Eastview Hills)which extends to the applicant's west property line. 3.Because of the topography of the applicant's lot (slopes to the west),it is questionable if the existing home can be served by extending the new main in 72nd Drive NE.However, extension of that main will eventually be required to serve property along 72nd Drive to the crest of the hill which is approximately 500'north of 49th Place NE. 4.The applicant is requesting connecting to the existing sanitary sewermain in 49th Place NE. A side sewer off the existing 8"stub to serve the applicant's property will be required,and it would be beneficial to complete this prior to the scheduled paving.It also may be required to extend this 6" side sewer along the applicant's west property line within a 10' private easement to provide gravity service to the lot north of the applicant's property. 5.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 6.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject RESOLUTION - 1 Iwpf/mv/perrault.res -~~-------------------------- property that do not apply generally to other properties in the same vicinity. 7. enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 8.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use,which is single-family residential. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: l. and for granted The variance for the applicant's connection to sewer waiver of the requirements of MMC 14.03.300 is hereby subject to the following conditions: a.The side sewer to the applicant's property shall be installed in accordance with the City's sanitary sewer design standards. b.The applicant shall enter into an agreement substantially in the form attached hereto as Exhibit A requiring the applicant to participate in his fair share of the cost of extending the 8"sanitary sewer in 72nd Drive NE at the time of installation. c.The applicant shall provide the City with a 10 foot utility easement in a form acceptable to the City along the west property line of the applicant's property for future side sewer installation to the adjacent lot on the north side.. d.The applicant shall pay all applicable fees and comply with all other applicable provisions of the Marysville Municipal Code. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. 2ASSED by the City Council and APPROVED by the Mayor this ~~day of May,2000.
