HomeMy WebLinkAboutR-1984 - Granting a utility variance for Michael Martin for property located at 6710 19th Ave NE Marysville WaCITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.198 1 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR MICHAEL MARTIN FOR PROPERTY LOCATED AT 6710 - 19TH AVENUE NE, MARYSVILLE,WASHINGTON. WHEREAS,on March 16,2000 Michael Martin applied for a utility variance for two temporary water connections and no sewer connection for property located at 6710 -19th Avenue N.E., Marysville,Washington;and WHEREAS,on April 24,2000 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The applicant's variance is for two temporary water connections without sewer for property located outside the City's RUSA boundary.The variance request is also for a waiver of the frontage requirements of MMC 14.03.300 and waiver of the City's annexation covenant requirement contained in MMC 14.32.040. 2.The applicant's well was tested on March 10,2000 and the results were unsatisfactory. 3.The applicant applied for a water connection to the Tribes'water system.A water connection at the designed connection point is not available from the Tulalip Tribes at this time. 4.The Tulalip Tribes have future plans to construct an eight-inch water main on the west side of 19th Avenue for a distance of 3,000 feet to provide water to the applicant and other affected homeowners.As a result,any connection to the City water system would be considered temporary. 5.The City of Marysville has an existing eight-inch water main along the east edge of right of way on 19th Avenue serving Marysville West.The applicant is requesting two temporary connections to this main until the eight-inch water main to be constructed by the Tulalip Tribes is complete. 6.The Reservation. not practical applicant's property is within the Tulalip Indian Annexation of property within the reservation is or feasible. 7.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. RESOLUTION - 1 /mv/martin.res ;..,, 8.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 9 . enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. 10.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is temporary and limited to the current use,which is one single-family residence. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's two water connections and no sewer connection,for service outside RUSA and for waiver of frontage is hereby granted subject to the following conditions: a.The applicant's connections to water shall be on a temporary basis until such time as the Tulalip Tribes have repaired the existing water main or constructed a new water main on the west side of 19th Avenue.When the new water main is constructed,the applicant shall connect to the same at his own expense. b.The applicant pay all applicable fees and charges set forth in MMC Title 14. c.The applicant comply with all provisions of the Marysville Municipal Code,with the exception of those matters for which a variance or waiver is granted. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. ~PASSED by the City Council and APPROVED by the Mayor this ;)2."day of -~~":::;;;f'/"------'2000.
