A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE
FOR DUJARDIN DEVELOPMENT COMPANY FOR PROPERTY LOCATED AT lOaTH
STREET N.E.AND 67TH AVENUE N.E.,MARYSVILLE,WASHINGTON.
WHEREAS,on March 15,2000 Dujardin Development Company
applied for a utility variance for one hundred ninety (190)water
and sewer connections for property located at lOath Street N.E.
and 67th Avenue N.E.,Marysville,Washington;and
WHEREAS,on May 1,2000 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The density of the applicant's proposed use is
consistent with the City's land use and sewer and water
comprehensive plans.
2.While the property is outside of the City's established
RUSA boundary,it is within the City's Urban Growth Boundary and
CWSP boundary.
3.There is an existing a-inch water main approximately
1,000 feet west of the northwest corner of lOath Street,and an
a-inch water main at the southwest corner of the subject
property.There is also an la-inch water main at 100th Street and
67th Avenue stubbed to the north (360 zone).The City's
Comprehensive Water Plan identifies an la-inch water main in 67th
Avenue connecting to an a-inch water main in lOath Street N.E.
4.The Marysville Comprehensive Sewer Plan calls for the
vicinity of the applicant's property to be served by a 2l-inch
lateral running from Trunk "A"at lOath Street and 51st Avenue
N.E.The developer would be required to install a 2l-inch
gravity sewer main in lOath Street to 59th Avenue reducing to an
8-inch gravity main to the crest of the hill in lOath Street.A
lift station located at the northeast corner of the applicant's
plat would pump sewage to the installed gravity at the top of the
hill.
5.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
6.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
8.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to the
proposed use,which is residential.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
sewer and water is hereby granted subject to the following
conditions:
a.The applicant shall construct all sewer and water
main improvements consistent with the City's comprehensive
water and sewer plans and consistent with the findings as
set forth above.
b.The applicant shall execute a covenant agreeing
not to protest annexation of the subject property to the
City of Marysville.
c.The applicant's development shall not exceed the
density allowed pursuant to the City's land use,water and
sewer comprehensive plans.
d.The applicant's development shall comply with all
applicable City of Marysville road standards.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
PASSED by the City Council and APPROVED by the Mayor this
day of June,2000.
