A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY
VARIANCE FOR BRYCE AND LIANNE ANDERSON FOR PROPERTY LOCATED
AT 14725 FORTY·FIVE ROAD,ARLINGTON,WASHINGTON.
WHEREAS,on April 27,2000 Bryce and Lianne Anderson applied
for a utility variance for one water connection and no sewer
connection for property located at 14725 Forty-Five Road,
Arlington,Washington;and
WHEREAS,on June 26,2000 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.On April 27,2000 the applicant completed a utility
commitment letter for one water connection.The applicant also
applied for a utility variance for one water connection and no
sewer connection.Sewer is not available.
2.The property is within the CWSP boundary.The property
is not within the City limits,the RUSA boundary or the Urban
Growth boundary.
3.There is a 12-inch water main in the Forty-Five Road
which fronts the applicant's property.
4.On December 7,1998,the previous owner of the subject
property was granted a utility variance for one water connection
for this parcel pursuant to Resolution No.1980.However,the
utility variance has expired.Other than a change in ownership,
conditions have not changed.
5.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
6.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.

The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
8.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City

limits,so long as this utility connection is limited to the
current use,which is single-family residential.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to City
water is hereby granted subject to the following conditions:
a.The applicant shall be provided one water
connection for a single-family residence only.
b.In the event the water pressure for the
applicant's property is substandard,the applicant may be
required to install a booster pump at his own expense.
c.The applicant shall be required to comply with all
other provisions of the City utility code.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
