A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE
FOR MICHAEL MULLIGAN FOR PROPERTY LOCATED AT 6207 - 70TH STRECT
N.E..MARYSVILLE,WASHINGTON.
WHEREAS,on June 13,2000,MICHAEL MULLIGAN applied for a
utility variance for one water and one sewer connection for a
proposed duplex and mobile home on lot 2 at 6207 -70TH STREET
N.E.,Marysville,Washington;and
WHEREAS,on August 28,2000 the City Council of the City of
Marysville held a public meeting concerning the variance
application and made the following findings:
1.The information contained in the City Council Agenda
Bill relating to this matter for the agenda of August 28,2000 is
hereby incorporated by this reference.
2.In light of the above-referenced findings,the
authorization of the variance will not be materially detrimental
to the public interest,welfare,or the environment.
3.The above-referenced findings reflect exceptional or
extraordinary circumstances or conditions applying to the subject
property that do not apply generally to other properties in the
same vicinity.
4.
enjoyment
possessed
The variance is necessary for the preservation and
of a substantial property right of the applicant
by owners of other properties in the same vicinity.
5.The granting of a variance in this case will not be
inconsistent with the long-range plans of the City utility system
or jeopardize utility availability for properties within the City
limits,so long as this utility connection is limited to th~
current use,which is a duplex and a mobile home.
NOW,THEREFORE, BF IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The variance for the applicant's connection to water
and sewer is hereby granted subject to the following conditions:
a.A six (6)inch side sewer serving lots 1 and 2 by
private easement shall not be approved.
b.The applicant shall provide a manhole with an
eight (8)inch stub to the right of way located within the

ingress/egress to lot number 2.
c.The applicant shall be required to extend an eight
(8)inch main to satisfy the frontage requirement along the
west property line.
d.A portion of the main which is extended will be
eligable for recovery pursuant to MMC 14.07.090 so long as
the side sewer stubs are installed to the property line and
a ten (10)foot permanent easement is granted to the City of
Marysville on an easement form acceptable to the City.
e.The applicant shall pay all applicable fees and
comply with all other provisions of Title 14 of the
Marysville Municipal Code.
2.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
