A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR DIANE BAUER FOR PROPERTY LOCATED AT 13030 -56TH AVENUE, MARYSVILLE,WASHINGTON. WHEREAS,on September 14,2000 Diane Bauer applied for a utility variance for thirteen (13)water and thirteen (13)sewer connections for property located 13030 -56th Avenue,Marysville, Washington;and WHEREAS,on October 23,2000 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.On September 14,2000 the applicant applied for a utility variance for 13 water and 13 sewer connections for property located outside of the City's RUSA boundary. 2.The applicant's property is within the City's CWSP and Urban Growth boundaries. 3.The property is not located within the City's RUSA boundary. 4.The applicant's request is consistent with the Comprehensive Water and Sewer Plan densities for the area which allow up to 4,5 du/net acre. 5.The applicant's property is adjacent to the City's service area.There is a 12-inch ductile iron water main in 132nd Street and a IS-inch sewer main in 132nd Street which lS capable of providing gravity sewer to the proposed plat. 6. municipal boundary. The Growth Management Act contemplates the provision of services to areas within the City's Urban Growth The applicant's property is within said boundary. 7.In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 8.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 9.The variance is necessary for the preservation and enjoyment of a substantial property right of the applicant RESOLUTION - 1 /wpf/mv/bauer.res • possessed by owners of other properties in the same vicinity. 10.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to City water and sewer is hereby granted subject to the following conditions: a.The City shall provide that number of water and sewer connections to the applicant's property which are consistent with and do not exceed the City's water and sewer Comprehensive Plan densities. b.The applicant shall meet all applicable provisions of Title 14 of the Marysville Municipal Code. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution. tlPASSED by the City Council and APPROVED by the Mayor this/3 day of November,2000.
