A RESOLUTION OF THE CITY OF MARYSVILLE AMENDING RESOLUTION NO.
1987 GRANTING A UTILITY VARIANCE FOR DUJARDIN DEVELOPMENT
COMPANY FOR PROPERTY LOCATED AT 108TH STREETN.E.AND 67TH AVENUE
N.E., MARYSVILLE,WASHINGTON.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON AS FOLLOWS:
1.Finding NO.4 of Resolution No.1987 is hereby amended
to read as follows:
4.The Marysville Comprehensive Sewer Plan calls for
the vicinity of the applicant's property to be served by a
21-inch lateral running from Trunk "A"at 108th Street and
51st Avenue N.E.The developer would be required to install
a 21-inch gravity sewer main in 108th Street to 59th Avenue
reducing to an 8-inch gravity main to the crest of the hill
in 108th Street.However,in lieu of constructing said line
at this time,the developer,its heirs,successors and
assigns,may execute a covenant not to protest the formation
of an LID to construct said line in the future.A lift
station located at the southeast corner of the applicant's
plat in the vicinity of 67th Avenue Northeast and proposed
65th Avenue Northeast would pump sewage to the installed
gravity line at the top of the hill.
2.Condition l(a)of Resolution No.1987 is hereby amended
to read as follows:
(al Except as otherwise provided in Finding No.4
above,the applicant shall construct all sewer and water
main improvements consistent with the City's comprehensive
water and sewer plans and consistent with the findings as
set forth above.
3.A new Condition l(e)is hereby added to Resolution No.
1987 which shall read as follows:
(e)The applicant,its heirs,successors and assigns,
shall covenant not to protest the formation of a future LID
for construction of a future proposed 21-inch sewer main in
108th Street.
4.This decision shall be final and conclusive with the

right of appeals by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
