CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.20.2.3 A RESOLUTION OF THE CITY OF MARYSVILLE GRANTING A UTILITY VARIANCE FOR DAVID O'CONNOR FOR PROPERTY LOCATED AT5318 108TH STREET N.E., MARYSVILLE,WASHINGTON. WHEREAS,on November 1,2000,DAVID O'CONNOR applied for a utility variance for two water connections and two sewer connections for property located 5318 108TH St.N.E.,Marysville, Washington;and WHEREAS,on December 4,2000 the City Council of the City of Marysville held a public meeting concerning the variance application and made the following findings: 1.The property is within the City's RUSA,CWSP and urban growth boundaries. 2.The applicant has proposed density for development of his property which is greater than that provided in the Marysville Comprehensive Plan and RUSA Plan. 3.There is an 8-inch water main in 108th St.which fronts the applicant's property and an 8-inch sewer main in 108th St.at 52nd Dr.,and in 108th St.east of the site. 4.The applicant is requesting a variance from the densities provided in the City's RUSA plan. 5.The densities provided in the City's Comprehensive Plan reflect a more current analysis of the City's long range plans than the densities provided in the City's RUSA plan. 6 In light of the above-referenced findings,the authorization of the variance will not be materially detrimental to the public interest,welfare,or the environment. 7.The above-referenced findings reflect exceptional or extraordinary circumstances or conditions applying to the subject property that do not apply generally to other properties in the same vicinity. 8 . enjoyment possessed The variance is necessary for the preservation and of a substantial property right of the applicant by owners of other properties in the same vicinity. RESOLUTION - 1 /wpf/mv/connor.res .----------------------------------.-------------------- 9.The granting of a variance in this case will not be inconsistent with the long-range plans of the City utility system or jeopardize utility availability for properties within the City limits,so long as this utility connection is limited to the current use. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS: 1.The variance for the applicant's connection to City water and sewer is hereby granted subject to the following conditions: a.That the applicant's development comply with City of Marysville road standards. b. with the plan. That the applicant's development is consistent density provided in the Marysville Comprehensive c.That the applicant install two water meters,one for each duplex unit. d.That the applicant meet all other applicable requirements of the City's Utility Code,MAC Title 14. 2.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by filing a Land Use Petition pursuant to the Land Use Petition Act within twenty-one (21)days after the passage of this resolution.
