A RESOLUTION OF THE CITY OF MARYSVILLE APPROVING IN PART AND
DENYING IN PART UTILITY VARIANCES FOR BORSETH CUSTOM HOMES, INC.
FOR PROPERTY LOCATED AT 10719 •60TH AVENUE NE, MARYSVILLE,
WASHINGTON.
WHEREAS,on March 13,2000 the Marysville City Council
approved Resolution No.1975 granting in part and denying in part
a utility~ariance for Boyden,Robinett &Associates,L.P.for
property located at 10719 -60th Avenue NE,Marysville,
Washington;and
WHEREAS,on December 19,2000 Borseth Custom Homes,Inc.,
having purchased the subject property from Boyden Robinett in
June 2000,applied for a variance for one water and one sewer
connection outside of the City's RUSA boundary and a variance
from the requirements of MMC 14.03.300 relating to coverage of
the property's frontage;and
WHEREAS,on January 22,2001 the City Council of the City of
Marysville considered the variance requests of Borseth Custom
Homes I Inc.;\.,
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MARYSVILLE,WASHINGTON AS FOLLOWS:
1.The facts and circumstances relating to these variance
requests have not changed since the application of Boyden
Robinett.
2.While Resolution No.1975 has expired,the findings
numbered 1 through 8 continue to apply and are hereby
incorporated by this reference.
3.Based upon the above-referenced findings,the variance
for the applicant's connection to water and sewer for property
outside the City's RUSA boundary is hereby granted subject to the
following conditions:
a.The applicant shall pay all applicable fees
required by Title 14 of the Marysville Municipal Code and
shall comply with all other requirements of City ordinance
including,but not limited to,the execution of an
annexation covenant pursuant to MMC 14.32.040.
4.The variance from the provisions of MMC 14.03.300 is
hereby denied.

5.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this resolution.
PASSED by the City Council and APPROVED by the Mayor this
