A RESOLUTION OF THE GTY OF MARYSVILLE EST ABLISGING APRIL 25,
2005 AS THE DATE UPON WfUrn A HEARING SHALL BE HELD BEFORE
THE MARYSVILLE CITY COUNCIL TO CONSIDER VACATION OF A
PORTION OF 36lli DRIVE NE,NORTH OF 116TH STREET NE AND SOlITH
OF UOlli STREET NE IN THE CITY OF MARYSVILLE.
WHEREAS,White-Leasure Development Company petitioned theCityof Marysville on
March 1,2005 to vacate aportionof 36
th Drive NE, northof 116mStreet NE andsouthof 120m
Street NE in the Cityof Marysville;and
WHEREAS,on March 28,2005 the Marysville CityCouncil considered the petition and
directed staffto schedule a public hearing pursuant to Chapter 12.32 ofthe Marysville Municipal
Code;NOW,'IHEREFORE,
BEIT RESOLVED BYTHE an COUNaL OF THE an OF MARYSVILLE,
WASHINGTON,AS FOLLOW'S:
Section 1.Pursuant to RCW35.79.010,incorporated by reference in RCW3sA47.020,and
pursuant to Marysville Municipal Code Section 12.32.020,April 25,2005 shall beandherby is
established asthe time at which the City Council ofthe City of Marysville shall holda public hearing
atthe Marysville CityHallat 7:00 PMor such laterhouras is available,to consider the right-of-way
vacation petition of White-Leasure Development Company requesting vacation ofaportionof
certain dedicated right-of-way generally located at36th Drive NE,north of 116th Street NE and
southof 120th Street NE,which is legally described in Exhibit A,attached hereto.
Section 2.Pursuant to Marysville Municipal Code Section 12.32.020,whenthe vacation is
initiated bythe City of Marysville,orthe City Council deems it in thebest interest ofthe City of
Marysville,the Council maywaive all or anyportionofsuch compensation.Atthe time the Council
initially has the petition before itinordertosetthe matterfor public hearing by resolution,the
Council shall consider the reports ofthe CityEngineer and!or the Community Development
Directorshall determine whether or not it will require thattheCitybe compensated asa condition
ofthe vacation.
Section 3. The CityEngineer and Community Development Directorhave recommended
the Council waive all compensation ofthe vacated right-of-way,based onthe following factors:
(a)36th DriveNE currentlydoesnot generate anytax dollars to the Gty.Vacating the existing right-
of-waywould allowthe proponent to assemble the remaining properties in orderto constructPhaseII of a
proposed commercial shoppingcenter,whichwould generate propertyand sales tax dollars for the City,
(b)The proposedshoppingcenter is inconfonnance with the 116mStreetmasterplan. The
proposal assembles all properties on the north sideof 116mStreet.This was a particularly difficult assembly
asit involved numerous existing single family residences anda mobilehome park
(c)The existing andprior residential uses areolderhomes,currently on septic with substandard
toads,lacking drainage facilities.Thecityof Marysville spent considerable resources addressing drainage
issues within this residential subdivision during a floodevent approximately seven years ago.Theproject
proposal will include construction and extension ofsewerand drainage facilities to serve the proposal,
improving the current infrastructure conditions.
(d)The residents located northoftheproposed commercial shopping centerwould be directed
througha lighted intersection,constructed atthe developers cost,allowing improved access,mobility and
muchsafer driving conditions.
(e)Thenew private road connection (38 th Drive NE)would be constructed at the developers cost.
The estimated costforthe Gryto construct theproposed improvement would be approximately $766,800,
based on a 3-lane roadway with curbs,gutters and sidewalks at an estimated rateof $1.8 million per lane mile
(0.142 miles (750 lineal feet)x 3 lanes x $1.8 million =$766,800),comparedto the costofthe vacated right-of.
waytotaling $366,360 or $398,330,based on $6.00 or $6.53 per SF.
