HomeMy WebLinkAboutR-2143 - Pertaining to implementation of the Snohomish Basin Salmon Conservation Plan and related commitments and conditions, I ,. c~-_.~-.e...__~~--.-.. -"'> CITY OF MARYSVILLE Marysville,Washington RESOLUTION NO.<9-.JI-/3 A RESOLUTION OF THE CITY OF MARYVILLE PERTAINING TO THE IMPLEMENTATION OF THE SNOHOMISH BASIN SALMON CONSERVATION PLAN AND RELATED COMMITMENTS AND CONDITIONS. WHEREAS,in March 1999, the National Oceanic and Atmospheric Administration (NOAA) Fisheries listed the Puget Sound Chinook salmon evolutionary significant unit as a threatened species under the Endangered Species Act (ESA);and WHEREAS,in November 1999, the United States Fish and WildlifeService (USFS)listed the Puget Sound bull trout distinct population segment as a threatened species under the ESA; and WHEREAS under the ESA, it is illegalto "take"a listed species, and the ESA defines the term "take"to include actions that could harm listed species or their habitat; and WHEREAS,under ESA Section 4(f),NOAA Fisheries (for the Chinook salmon) and USFWS (for bull trout) are required to develop and implement recovery plans to address the recovery of the species; and WHEREAS,one of the most essential elements for the development and implementation of effective recovery programs is coordination and cooperation among federal. state, and local agencies, tribes,non-governmental organizations,and private citizens; and WHEREAS,Shared Strategy for Puget Sound, a regional non-profit organization,has assumed a lead role in the Puget Sound response to developing a recovery plan for submittal to NOAA Fisheries and USFWS, and WHEREAS,the City of Marysville is a member of the Snohomish Basin Salmon Recovery Forum and assisted in the development of the Snohomish Basin Salmon Conservation Plan (plan) that will become a chapter in the regional recovery plan; and WHEREAS,Shared Strategy intends that its recovery plan willinclude implementation commitments from partners such as local governments,special districts,non-governmental organizations,and interest groups; and WHEREAS,NOAA Fisheries and USFWS can provide certain regulatory assurances to local governments that commit to implement a recovery plan; and WHEREAS,the City of Marysville values ecosystem health, the protection of salmonids, water quality,and flood hazard reduction;and maintaining a legacyfor future generations,including commercial, tribal, and sport fishing;aesthetic quality of life,and cultural heritage; and WHEREAS,the City of Marysville has recently adopted updated policies and regulations that should be consistent with recommendations necessary for Chinook salmon and bull trout recovery and watershed health; and WHEREAS,the City of Marysville supports regional cooperation to set common priorities for action among partners,efficient use of resources and investments,and distribution of responsibility for action and expenditure;and RESOLUTION - 1 WHEREAS,it is important to provide certainty and predictability about actions for jurisdictions,the private sector and the public that what is in the Snohomish Basin Salmon Conservation PIan is the course of action we as a region will be taking: NOW,THEREFORE,be it resolved by City of Marysville as follows: Subject to the conditions stated below, the City agrees: 1.To support the goal of the Snohomish Basin Salmon Recovery Forum to protect,restore, and enhance the productivity of all wild salmon stocks in the Snohomish Basin to a level that will sustain fisheries and non-consumptive salmon-related cultural values. 2. To support the long-term vision of the Snohomish Basin Recovery Plan. 3. To support the ten year habitat improvement milestones in the Snohomish Basin Salmon Recovery Plan as a clear path to making significant progress towards salmon recovery. 4.Incorporate best management practices into development permits to reduce impacts to remaining habitat.. 5.Continue to accommodate growth within Urban Growth Areas, as mandated by the Growth Management Act,without unnecessarily expanding Urban Growth Areas to accommodate future growth. 6. To work to confirm our commitments to implement the Snohomish Basin Salmon Conservation Plan provided the following conditions are met: CONDITIONS.Conditions necessary for commitment to plan implementation: 1.NOAA and USFWS will each adopt this Plan, as part of an operative element of their recovery plans for the Puget Sound Chinook Salmon and bull trout;and 2.The State of Washington accepts this Plan as the best science available and basin recovery strategy for the purposes of allocating funding; 3.If the City of Marysville implements the Plan as outlined above and is making progress,then NOAA Fisheries and USFWS: a. Shall not take any direct enforcement actions against them,and b. Shall endorse the Plan and its actions and shall defend them against legal challenges by third parties; and c. Shall reduce the regulatory burden for city activities that require an ESA Section 7 consultation. 4.Requests rewards for implementing the pIan through: a.Streamlined permitting for City of Marysville's projects that are implemented primarily for the purpose of habitat restoration;and b.Development of a programmatic permit that would cover actions that are consistent with Plan priorities and policies;and c.Direct funding and other monetary incentives to cover the majority of costs of implementation.
