A RESOLUTION OF THE CITY OF MARYVILLE;WASHINGTON,
DECLARING REAL PROPERTY LOCATED AT 7610 -47'h AVENUE N.E.,
MARYSVILLE,WASHINGTON,TO BE SURPLUS TO THE NEEDS OF THE
CITY OF MARYSVILLE AND AUTHORIZING THE SALE OR LEASE OF
SUCH PROPERTY.
WHEREAS,the City previously purchased certain real property within the City limits
located at 7610 -47th Avenue N.E.,Marysville,Washington,which is legally described on
EXHIBIT A attached hereto and made a part hereof by this reference (the "Property");and
WHEREAS,the Property was considered for a variety of public purposes,including
public utility purposes;and
WHEREAS,after consideration,review and study of potential public uSes and the
suitability of the property for siting the City Public Works Department and related facilities,it
appears that the Property is surplus to the needs of the City;and
WHEREAS,pursuant to RCW Chapters 39.33 and 35.94,the City will conduct a public
hearing regarding whether to dispose of and sell the Property;and
WHEREAS,after consideration of available revenues and expenses in the City's 2011
budget,the City Council finds that it is in the best interests of the City of Marysville to declare
the Property surplus and authorize the sale or lease ofthe Property;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CrfY
OF MARYSVILLE,WASHINGTON AS FOLLOWS:
Section 1.The Property located at 7610 -47th Avenue N.E.,Marysville,Washington,
which is legally described on EXHI81T A attached hereto and incorporated herein by this
reference,is hereby declared surplus to the needs of the City of Marysville.
Section 2.It is in the best interest of the citizens of Marysville to sell or lease said
surplus Property.
Section 3.The City Council hereby finds that the subject property in its current condition
is not subject to an authorized public use and is surplus to the City's needs.The Property or arty
portion thereof may be sold or leased through a sealed competitive bid process,with the
assistance of a real estate agent through a multiple listing service,or in such other manner as in

the discretion of the Chief Administrative Officer of the City will produce the greatest return on
the property to the City.
Section 4.Prior to the final sale,lease or disposition of the Property,the City will
conduct a public hearing and shall adopt by separate resolution a statement of the fair market
value or the rent or consideration to be paid and such other terms and conditions for such
disposition as the City Council deems to be in the public interest.
Section 5.Subject to final approval of the City Council,the Mayor and his designee are
hereby authorized to take all necessary and appropriate steps to sell and transfer or to lease said
Property or a portion or portions thereof in accordance with applicable federal,state and local
law,including but not limited to negotiation and execution of all contracts,real estate purchase
and sale agreements,leases and other legal documents required to sell and/or lease the Property.
