A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON DECLARING AN EMERGENCY AND WAIVING THE
REQUIREMENT FOR PUBLIC BIDDING FOR REPAIRS TO THE WATER
MAIN NEAR STA TE A VENUE AND 1 ooTH ST NE
WHEREAS , the City experienced a water main rupture on July 18, 2016 near State
A ven ue and 1 oat h St NE due in part to aging asbestos cement pipe erosion across steep slopes;
and
WHEREAS, thi s rupture was unforeseen and beyond the control of the City; and
WHEREAS, a lap se in the repair poses operational risks to the City's water syste m ,
including reduced press ure and fire flow to the service area ; and
WHEREAS , the reduced pressure and fire flow pre se nts a real , immediate threat to the
proper performance of essential municipal functions resulting in an emergency si tuation as
defined in RCW 39.04.280(3); and
WHEREAS, the process for competitivel y bidding a permanent repair to the water main
and associated restoration will take approximately three to six-months to complete; and
WHEREAS , said emergency requires the immediate attention of a general contractor
capable of performing the repairs; NOW, THEREFORE,
BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE AS
FOLLOWS :
Section 1. The City Council adopts as its findings of fact the recitals above.
Section 2. Pursuant to RCW 39.04.280, the City Council declares that an emergency existing
as of July 18, 2016 and waives the competitive bidding requirement for the State Avenue and
100 1h St NE water main repair.
Section 3. The Mayor or his designee is authorized to enter into and execute an agreement
with a general contractor as to be determined .
