'J-'-f08 A RESOLUTION OF THE CITY OF MARYVILLE STATING ITS INTENTION TO ANNEX CERTAIN UNINCORPORATED AREA, KNOWN AS THE WSDOT ROW ANNEXATION, INTO THE CITY, AND TRANSMITTING THE MATTER TO THE WASHINGTON STATE BOUNDARY REVIEW BOARD FOR SNOHOMISH COUNTY FOR APPROVAL WHEREAS , the City of Marysville has received a petition for annexation of certain property generally encompass ing Washington State Depa rtment of Transportation (WSDOT) Interstate 5 a n d State Route (SR) 529 Right-of-Way (ROW), north of Steamboat Slough and south of Ebey Slough, be ing tho se portions of the Nort hw est Quarter AND Southwest Quarter of Sect ion 33, T owns hip 30 North, Range 5 East, WM, said property being co ntiguou s to th e city limits a nd lega ll y described in Exhibit A and dep i cted in EXHIBIT B attached hereto; and WHEREAS, a duly adve rti sed public hearing was h e ld before the Marysville Planning Commission on October 25, 2016 to co n side r PRE -ZONING properties w ithin th e WSDOT ROW Ann exa tion co n s isten t with the Mary svi ll e Comprehensive Plan; and WHEREAS , on October 25, 2016, the Marysville Planning Commission h eard testimony from staff, and th e public at the public hearing and recommended Marysville City Council adopt zoni ng consis tent wit h the Marysville Compreh ensive Plan Land Us e Map with an implementing zon ing designation of General Indu strial (GI), for the property described in Exhibit A and depicted in EXHIBIT B attached h e r eto; WHEREAS , th e area o f the proposed an n exat ion is wit hin the re cog nized Urba n Growt h Area for the City of Marysv ill e, as estab li shed by Snohomi s h County, and e liminates this unincorporated i s land w ithin the Urban Growth Area and the City of Mary sv ill e; a nd WHEREAS, a duly advertised public h ea ring on said annexation petition was held before the Marysville City Council on November 28 , 20 1 6 and January 9, 2017 in acco rd a nce wit h RCW 35 A .14, a nd the City Council h ea rd testimony fr om staff a nd the public, and was fully adv ised in the premises; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON, AS FOLLOWS: Section 1 . T he property described in Exhibit A and depict ed in EXHIBIT B attac h ed hereto, is hereby approved for an n exatio n into the City of Marysv ill e and s hall be so a nn exed by ordinance of th e City of Marysv ill e u pon r ece ipt of a f avorab l e dec isi on/r epo rt from the Was hin gton State Boundary Rev i ew Board for Snohomish County. Section 2 . Upon annexation of the prop e rty describ ed in Exhibit A a nd depicted in EXHIBIT B att ac h ed he r eto, it shall be assessed and taxed a t th e same rat e and o n the same basis as othe r prope rt y w it hin t h e City of Ma r ysv ill e, in c luding assessments or taxes for the payment o f its pro rata share and al l outstand ing ind eb t edness o f the City co ntrac t ed or in cur r e d pri or to or ex i st in g on the e ffec tive date o f t h e annexat ion. Section 3. Upon annexation, the property described in Exhibit A and depicted in EXHIBIT B shal l be subject to the City of Marysville Comprehensive Pl an Land Use Map with an implementing zoning designation of Ge nera l Commercial (GI). Section 4 . The Community Development Department is hereby authorized to transmit a copy of this resolution, Notice of Intention to Ann ex and all Ex hibits thereto, along with an appropriate map depicting the annexation area and all information necessary to support the proposed annexation to the Snohomish County Boundary Review Bo ard for consideration and r ev iew .
