HomeMy WebLinkAboutR-2467 - Affirming the recommendation of the hearing examiner and granting a Conditional Shoreline Substantial Development Permit to replace the existing box cCITY OF MARYSVILLE Marysville, Washington RESOLUTIONNO. 2f b 1 A RESOLUTION OF THE CITY OF MARYSVILLE AFFIRMING THE RECOMMENDATION OF THE HEARING EXAMINER AND GRANTING A CONDITIONAL SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT TO REPLACE THE EXISTING BOX CULVERT UNDER STATE AVENUE WITH A SINGLE SPAN BRIDGE OVER QUILCEDA CREEK. WJIEREAS, the City of Marysville owns certain right-of-way within State Ave between 1001h St NE and 104'h St NE, in the City of Marysville, and is in the process of obtaining additional right- of-way and temporary construction easements for the project; and WHEREAS, the City of Marysville Public Works Department applied to the City Community Development Department for a conditional Shoreline Substantial Development Permit to replace the existing box culvert along Quilceda Creek with a single-span bridge together with associated improvements; and WHEREAS, a SEPA Threshold Determination of Non-Significance was issued by the City Community Development Department on January 17, 2019; and WHEREAS, the City Hearing Examiner held a public hearing on March 5, 2019 and adopted Findings of Fact, Conclusions and a Recommendation approving the conditional Shoreline Substantial Development Permit subject to eight (8) conditions; and WHEREAS, the City Council held a public meeting on said conditional Shoreline Substantial Development Permit on March 25, 2019 and following a review of the record before the Hearing Examiner concurred with the Findings of Fact, Conclusions and Recommendation of the Hearing Examiner; NOW, TI IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON AS FOLLOWS: 1. The Findings of Fact, Conclusions and Recommendation of the Hearing Examiner with respect to the above-referenced conditional Shoreline Substantial Development Permit under File No. PA 18-033 is is attached as Exhibit A and adopted by this reference as the decision of the City Council. 2. The conditional Shoreline Substantial Development Permit for the above described property shall be conditioned upon compliance with each of the conditions set forth in the Recommendation of the Hearing .Examiner. 3. Violation of any of the conditions of said decision may result in revocation of the conditional Shoreline Substantial Development Pennit or enforcement action being brought by the City. 4. This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Shorelines Hearings Board pursuant to RCW 90.58.140(6). RESOLUTION -1 5.
