HomeMy WebLinkAbout0020 - Arlington, City of - Agreement Amended - Municipal Court Services #6SIXTH AMENDMENT TO fNTERLOCAL AGREEMENT FOR MUNICIPAL COURT SERVICES BETWEEN T H E C ITY OF MARYSV ILLE AND THE CITY OF ARLINGTON PROVID fNG FOR TRANS ITION OF COURT SERVICES TO SNOHOMI SH COUNTY DISTRlCT COU RT WHEREAS, the City of Marysville Munic ipal Court has provided court services to the City Arli ngton purs uant to a n interlocal agreement ("O ri g inal Agreement") recorded with the Snohomish County Auditor on April 4, 2003, and subsequentl y amended; and WHEREAS , the City of Arlington wishes to transition its municipal court service s to the Cascade Division of the Snohomish County District Court ("Di strict Court"); and WHEREAS , both parties wish to complete an orderly transition of cases originall y filed in the Marysv ill e Court; and WHEREAS , the parties agree that prov idi n g a transition period to the end of the year is suffic ient to provide for an orderl y trans iti on. NOW, THEREFORE, in consideration of th e terms and provisions of this amendment; it is agreed by Marysville and Arlington as follows: 1. Ar li ngton will not fi le any criminal cases or infractions with th e Marysvi ll e Court after February 29, 2020. Beginning March 1, 2020, a ll criminal cases and infractions w ill be filed with the District Court. 2. The presiding judge of District Court may appoint the judges of the Marysville Court as pro tern judges for Distri ct Court. For the purposes of this agreement, the pro tern appointment wi ll be limited to c riminal cases and infractions th at were fil ed in the Marysvi ll e Court. The duration of the appointm ents will be until December 31, 2020, or such earlier date as determined by Arlington or the District Court. 3. The judges of the Marysville Court acting with the authority of the pro tern appointments will continue to provide court services under the terms of the Original Agreement (and its amendments) for cases and infractions that were filed in the Marysville Court. The cases will be heard in the Marysvi ll e Municipal Court located at 10 15 S ta te Avenue, Marysvill e, Washington. The Di strict Court will take any action or enter apy adm ini st rative orders it deems necessary to carry out this provision of this agreement. If the District Court chooses not to appoint the Marysville judges as pro tern judges of the District Court, Marysville will have no further respons ibi lities under the Original Agreement, except to transfer necessary records to Arlington or the District Court. 4. There are nine cases that had probation jurisdiction o f five years imposed by the Marysville Court a nd that ha ve been su pervised by the Marysville probation officer. The length of probation was due to these being deferred prosecutions or domestic v io lence cases. To ensure continuity of the supervision of these cases, they will be transferred to the District Court 's probation office by March 31 , 2020. After March 1, 2020, Marysville will no longer be entitled ORlntNAl ~ to the probation fees coll ected on these cases. The Marysv ille Court will provide records requested by the District Court's probation office to assist in the supervision of these cases. A list of these cases is attached as Exhibit A. 5. In frac ti ons th at were fi led and fo und committed by the Marysville Cou rt may remain in colle ctions after December 31 , 2020. These cases remain in the JI S system and may be closed/written off in acco rdance w it h the poli c ies of t he Ad mini strative Office of Courts (AOC) after t en years have e lapsed. It is n ot possi bl e to transfer these cases to District Court due the manner in which the y are e nte red into JIS . The Marysville Court wi ll continue to ad mini s trat ive ly c lose the se cases in acco rdance with AOC polici es. The parties agree tha t the Marysvi ll e Court's administrative staff is authorized to perform this duty and t he District Court may en ter any adm in istrative order or take o ther action it bel ieves necessary to authorize this functi on . T he a uthori zatio n to close these cases wi ll s u rvive the termination of the Original Agreement on December 31, 2020. 6. If a person has bee n found by the Marysvi lle Court to have comm itted a n infracti o n because t hat person fai led to appear and seeks to ha ve that fi nding set as id e , and the request is made after December 3 1, 2020, or at a time when it is not poss ibl e for the Marysvill e Court to schedul e a hearing before December 3 1, 2 020, the Marysvill e Court w ill forward the request to the Di strict Court. 7. T hi s agreem e nt and th e Orig in al Agreement w ill terminate on December 3 1, 2020.
